Property Maintenance

Chapter 290 Property Maintenance Ordinance was enacted in June 2012.  The proposed changes are designed to enhance the Town's ability to enforce the Property Standards.  The new wording is highlighted below.  For a full reading of Chapter 290 click here.

 

§ 290-5. Grounds maintenance standards.

The grounds of any property shall be kept in good repair and free of unsafe or unsanitary conditions. Such conditions may include excessive vegetation, and properties may be deemed unsafe or unsanitary if they are found to contain: refuse, household trash, junk, discarded plumbing, heating supplies, old or scrap copper, brass, rope, rags, batteries, paper trash, rubber, waste and all scrap iron, steel, other scrap ferrous or nonferrous material, debris, scrap lumber, inoperable machinery or part thereof, glass, unused and inoperable appliances, worn and unused furniture, and one or more junked and/or unserviceable vehicle(s), other than those licensed for storage according to the Town of Madison Automobile Graveyard and Junkyard Ordinance.[1] Materials intended for the private use of the property owner may be stored on the property as long as such material is screened from the public way and from abutting properties and is not in violation with state laws. Private use does not include resale

§ 290-8. Enforcement; violations & penalties; extensions.

A. The CEO, or their designee, shall notify the violator, serving a written notice by certified mail or by hand delivery. Said notice shall explain the nature of the violation and require corrective action within 30 calendar days from the date of the receipt of the notice to correct the violation, seven days (maximum) for a health and/or safety violation as determined by the CEO. The violator may appeal the CEO's decision to the Board of Selectpersons. Appeals must be made within three working days of notification by the CEO of a violation. The number of days given for compliance shall start after the Board of Selectpersons has heard the appeal.

B. If a violation is not corrected within the time allowed, the Town shall pursue all remedies including pursuit of a judge’s order to abate the property and remove the material in violation at the property owner’s expense. In addition the Town shall pursue relief available by law and/or in equity for land use ordinances, including, without limitation, the remedies and relief provided in 30A M.R.S.A. § 4452, currently including, without limitation, a penalty of $100 to $2,500 per day for a specific violation, injunctive relief and reasonable attorney fees, expert witness fees and costs. The Town shall retain all penalties set forth in this chapter.

Statement of Purpose: Certain areas of the Town of Madison are more densely populated. The purpose of this chapter is to set a boundary to be called the Madison Village Area where there is a population density of at least 500 residential dwellings per square mile. This chapter serves as a reference point for future ordinances that may pertain to protecting property values in densely populated areas.

Definition: An area within the Town of Madison consisting of more densely populated homes and businesses.

Criteria: More than 500 residential homes per square mile.

Area: The intersection of Kennebec Street and Old Point Avenue marks the beginning of the Village Area extending northbound along Old Point Avenue through the intersection with Main Street and continuing to the intersection of Old Point and Wedge Street. The intersection of Water Street and Main Street marks the beginning of the Village Area extending eastbound along Main Street to the Madison Area Health Center on Garden Street. The Village area extends along Preble Avenue to the intersection with Cedar Street, along Madison Avenue to the intersection with Learner’s Lane, along Park Street to the entrance to Forest Hill Cemetery and also includes Nathan Street to the Madison Boat Landing.

Special Town Meeting

On Wednesday night February 25th there will be a Special Town Meeting to take action on a citizen's petition regarding the elimination of the Madison Board of Assessors.  This meeting begins at 7pm at the Madison Junior High Auditorium.  Residents will be asked if they want to abolish the seperate board of assessors and transfer the Town's assessing functions to the Board of Selectmen. 

This meeting will not have any bearing on the 2014 Town Valuation or the 2014 Valuation of Madison Paper Industries.

Halloween Happenings

trickortreatIn Town there are a number of safe, fun places for kids to "Trick or Treat" and for families and businesses to get in on the fun.  Halloween night October 31st from 5 to 7 at the Main Street Park it's the second annual "Trunk or Treat" with cars parked around the parking lot with trunks open, decorated and yes FULL OF CANDY!  If your family or business would like to decorate a trunk call 431 0155 for more information.

Across the street at Maplecrest Nursing Home the staff and residents will be handing out candy to Trick or Treaters from 5 - 7 pm.

And just down the road Foshay's Information Booth it another candy spot on Halloween Night. 

Special Town Meeting - Local Tax Rate

Tax bill have not been sent out for 2014 because Town Officials are still working to set the official tax rate for the year.  The change in valuation at Madison Paper (UPM Madison) will cause a signficant increase in the tax rate.  An information meeting and Special Town Meeting is scheduled for Tuesday September 16th to discuss options and vote on proposals to provide residents with some tax relief.  The meeting begins at 7pm at the Madison Junior High School.
